Our firm offers free consultations to accident victims and their loved ones. We do not charge any fees unless we recover compensation for you through a settlement or verdict. Even in the unlikely event that a case is lost, we do not charge one penny of our expenses, no matter how large, to our clients unless their case is successful. Members of our team are bilingual in English and Spanish, and we represent people in the Bronx, Brooklyn, Queens, and Manhattan, as well as in Nassau, Suffolk, and Westchester Counties. We also offer our clients seasoned investigators, including a former N.Y.P.D. detective, on our staff to ensure that every case is properly investigated from the moment it is accepted into our firm. New York has been a “no-fault” insurance state since the 1970s. Under Department of Insurance Regulation 68, only people who sustain a “serious injury” in a car crash or another motor vehicle collision may file a claim for damages beyond what is available through no-fault insurance coverage. To successfully pursue a personal injury claim following a rear-end crash, a head-on collision, or a side-impact accident at an intersection, the plaintiff must prove four main elements. These are that the defendant owed a duty of care to drive safely, this duty was breached, the plaintiff suffered injuries, and there was a causal link between the breach of duty and the damages.
For example, drivers are supposed to keep a proper lookout behind the wheel. However, distracted driving accidents are common in New York City and the surrounding areas. A motorist who is looking down at their phone in order to read a text message probably will be found to have breached the duty of care. If the plaintiff is seriously injured, they may be able to recover not only compensation for medical expenses and lost wages but also compensation for pain and suffering and other damages. Time is of the essence in legal matters pertaining to accidents, so it is critically important that people who have been hurt seek counsel from a personal injury lawyer in the Bronx or elsewhere as soon as they can.Truck Accidents
The massive size and weight of commercial trucks make collisions involving them especially likely to result in catastrophic injuries. Fortunately, victims injured in truck accidents often can pursue compensation from the truck driver’s employer as well as the individual driver. This is important because trucking companies usually have substantially more assets and insurance than the average driver. An injured person often will try to show that the driver was acting in the course and scope of their job at the time of the crash. If the trucking company acted negligently in hiring, supervising, or training the driver, or in maintaining its vehicles, it may be held independently liable for an accident as well.
These cases are generally fiercely contested by trucking companies and their insurers, so it is important to get a skilled truck accident attorney on your side from the outset. At Jesse Minc Law Group, we can investigate the circumstances that led to your crash, such as whether a violation of federal or state regulations may have been involved. For example, if a trucker violated hours of service rules and stayed behind the wheel for too long, their fatigue may have contributed to a crash. We can also ensure that evidence is preserved and that experts are retained to support your case as needed.Motorcycle Accidents
While people inside cars and trucks have some protection from the impact of other vehicles, motorcyclists are unfortunately exposed to the elements. They may even be thrown from their motorcycles onto the roadway, suffering injuries such as road rash, spinal cord injuries, and complex fractures. Our Bronx personal injury attorneys can build a case to demonstrate the full amount of damages that a motorcycle accident has caused to the victim and their family. A common argument raised by defendants and insurers in these cases is that the motorcyclist was at least partly responsible for the accident. Under the comparative negligence rule in New York, however, you still can receive compensation that is proportionate to the defendant’s degree of fault, unless you were entirely responsible for your own injuries. We can craft a strategy to help you prevent the defendant from dodging accountability for their careless actions.Construction Accidents
With hundreds of buildings being constructed, renovated, or repaired at any given time in New York City, construction accidents are unfortunately not uncommon. Sometimes victims in these accidents may be able to pursue workers’ compensation benefits, but this is often not their only recourse. Workers who are members of a trade union may have additional benefits available to them in the event of a construction accident, such as pension benefits and additional medical coverage. It is essential to pursue options beyond simply accepting workers’ compensation benefits because workers’ compensation benefits are more limited than the compensation that may be available in civil claims, and workers’ compensation insurance carriers will fight tooth and nail to deny you fair compensation through the workers’ compensation system. There are specific state laws and regulations that may apply after a construction accident. For instance, the “Scaffold Law” found in New York Labor Law § 240 may apply in cases involving a fall from a height or an accident caused by a falling object. Additionally, a violation of New York Labor Law § 241(6) may be a basis to establish the liability of a contractor or another party involved at a work site. Our team is routinely recognized as being at the top of the field in representing victims of Bronx construction accidents, and will ensure that you are fairly compensated if you are hurt on a job site.Premises Liability
Injuries on someone else’s property can take many forms. People may suffer trip and fall or slip and fall accidents inside places of business, such as shopping centers, restaurants, or bars. They may also be injured at office buildings, apartment complexes, or residential homes. Our on-staff former N.Y.P.D. detective will work hard to find witnesses and secure key evidence to help prove your premises liability case. Our Bronx personal injury lawyers can help you seek to prove that the property owner failed to use the appropriate care in inspecting and maintaining the premises. Businesses, for example, are expected to protect their customers from safety hazards of which they are aware or reasonably should be aware. Depending on the circumstances, this might involve placing “wet floor” signs after mopping a floor, or it might involve improving lighting and other security measures to reduce the risk of crime.Public Transportation Accidents and Government Liability
Accidents involving public transportation in New York City, such as subways or trains, buses, or ferries, can result in serious injuries to many victims. If you have been involved in this type of accident, you should be mindful that the procedural rules are different in these cases than in a lawsuit against a private party. Specific notice of claim requirements and a shortened statute of limitations require seeking legal assistance as soon as possible. In these cases, government officials or governmental entities may attempt to avoid liability through governmental immunity or qualified immunity doctrines. This makes it especially important to retain an attorney who understands the nuances of the distinctive rules in this area. At Jesse Minc Law Group, we can anticipate complex defense strategies like these and develop arguments against them to ensure that you have the best possible chance of success from the very start.Medical Malpractice
Medical mistakes like surgical errors, medication errors, birth injuries, or improper diagnoses can be grounds for a medical malpractice lawsuit if a departure from the applicable standard of medical care is proven. The core of these cases usually consists of providing expert testimony from a health care provider in the same specialty as the defendant. Your expert must testify that the defendant health care provider breached the applicable standard of care in their specialty, considering your specific situation. They also must to discuss how the defendant’s inadequate care led to the patient’s injuries, a concept known as “causation”. For instance, if a health care provider failed to promptly diagnose your loved one with cancer in its early stages, the disease might have progressed more swiftly than it would have otherwise, causing them to suffer an untimely death. Our personal injury lawyers can help Bronx residents and other victims enlist knowledgeable experts to explain technical medical concepts to a judge or jury.Wrongful Death
Some of the most severe accidents take the lives of one or more victims. This can cause devastating grief to their families and also create significant financial burdens. Relatives are legally entitled to hold a person, business, or government entity accountable for their loss. They may be able to recover compensation for funeral expenses, the medical treatment of the victim before their death, any loss of financial support (such as earning power) that had been provided by the deceased victim prior to their death, and the conscious pain and suffering endured by the victim as a result of the accident prior to his or her untimely demise. Other damages available in these claims may relate to the relationship between the victim and their family members, such as their loss of companionship and support. When our office handles a wrongful death claim, we also provide assistance to the family with respect to the administration of the accident victim’s estate at no additional charge. We understand the challenges that families face in these tragic situations, and we want to help you get your life back on track as smoothly as possible.Civil Rights Violations
When police or other law enforcement officials use excessive force in detaining a suspect or effectuating an arrest, the defendant may have a civil rights claim under 42 U.S.C. § 1983. This federal law also provides a basis for claims related to malicious prosecution, wrongful arrest, false imprisonment, or other causes of action. The rights protected by this law arise under the U.S. Constitution and federal laws, so a claimant does not need to exhaust their options under state law before taking action. The defendant must have been acting under color of state law and must not be immune under the Eleventh Amendment, and the right must have arisen from a law that was meant to benefit people in the plaintiff’s position. Cases under these laws are often especially complex, but our attorneys have extensive experience and a track record of success with these proceedings in both state and federal court and will help you navigate the process from start to finish.Brain Injuries
With nearly a century of combined experience, our personal injury attorneys assist Bronx residents and other victims in New York City pursue compensation for traumatic brain injuries (TBI). These are usually caused when the victim’s head is struck by an external force. An object may penetrate the victim’s skull, which is known as an open or penetrating head injury, or it may simply jolt the brain inside the victim’s skull, which is known as a closed head injury. A concussion is a common type of brain injury that often arises from whiplash in situations such as motor vehicle collisions. Another common example is a contusion, which results when bruising causes bleeding in the brain. Our firm has strong relationships with potential expert witnesses in multiple fields, including not only doctors and nurses, but also psychiatrists and forensics experts. They can help explain the scope of the harm that you have suffered and outline the treatment that you are likely to require in the future. This proof is absolutely essential in persuading a jury to award you adequate compensation for your past and future damages if you suffer a traumatic brain injury.Spinal Cord Injuries
Victims of catastrophic accidents may suffer spinal cord injuries like paralysis, paraplegia, quadriplegia, or triplegia. These injuries are often classified as complete or incomplete. A complete spinal cord injury involves the loss of all functions below the area where the injury occurred. By contrast, in an incomplete spinal cord injury, the victim retains some motor or sensory functions below the injury site. Car accidents are the most common cause of spinal cord injuries in the U.S., with falls being the second-most common. Victims and their families typically require assistance with treating these injuries for many years or even a lifetime, the costs of which are often astronomical. Spinal cord injuries, especially those involving any degree of paralysis, always involve considerable pain and suffering which we will ensure is properly demonstrated to the jury in your case.Burn Injuries
Although many burn injuries resolve with time, even the smallest burns will cause significant pain and suffering for a victim. The severity of a burn is classified as first, second, third, or fourth degree. First-degree burns are relatively minor and generally affect only the outer layers of skin, while third- and fourth-degree burns affect all of the layers of skin and typically do not resolve without substantial medical intervention. In the most serious cases, fourth-degree burns may even result in the loss of the affected body part or permanent tissue damage. Our team of personal injury attorneys are standing by to assist burn injury victims in the Bronx and New York City gather the proper evidence to prove the full scope of their burn injuries and the suffering that they have endured. Pain and suffering is a relatively subjective element of damages, and for this reason retaining the right legal counsel will often make a huge difference in the amount of any award or settlement that you receive. Serious burn injuries can also involve very high medical bills for which you may be entitled to compensation if you suffer a burn injury.Workers' Compensation
When a New York City worker is hurt on the job, they may pursue workers’ compensation benefits from their employer or its insurance company. The employee must be able to prove that they were injured or developed an occupational illness during the course and scope of their employment. However, they do not need to show the fault of their employer in causing the accident, and benefits are available even if they caused their own injuries. Disputes sometimes arise regarding whether the alleged job-related injuries actually arose from a pre-existing condition unrelated to the victim’s job. Also, an insurer may contest the scope and duration of the employee’s impairment. We can help you present a strong case in the initial claims process and in any appeal that may be necessary.Social Security Disability
The federal government provides disability benefits to people who meet its definition of a “disability.” Social Security benefits are separate from workers’ compensation benefits and do not depend on a connection between the injury and the victim’s workplace. A claimant must show that their disability has lasted or will last for at least one year or will result in their death to qualify for these special benefits. The Social Security Administration maintains a manual that lists certain conditions that automatically qualify a claimant for benefits if they can show that they meet the criteria. However, benefits still may be available if a claimant can show that their condition prevents them from working in their previous job or any other type of job that may be available. Many meritorious claims are initially denied, only to be granted upon an appeal if handled properly.Contact an Experienced Personal Injury Attorney in the Bronx or Elsewhere in NYC
