Circumstances Involving Bus Accidents

The Metropolitan Transit Authority (MTA), an agency of the state government, operates public transportation systems in New York City, on Long Island, and elsewhere in the state. It operates New York City’s public bus system through MTA Regional Bus Operations (RBO) and the New York City Transit Authority. More than 5,700 buses run on over 300 routes throughout New York City. They share the streets with other drivers and pedestrians, creating countless risks for accidents and injuries, and have a legal duty to operate in a safe and reasonable manner to avoid causing accidents on the road.

Thousands of privately owned and operated tour buses and charter buses also move through New York City on a daily basis. They are often the same size as city buses, and therefore they pose the same risks. This became apparent in 2017, when a private tour bus collided with a city bus in Queens, resulting in three deaths and numerous injuries. Indeed, the examples of negligent bus operation throughout the City are too numerous to count; and, unfortunately, due to the sheer mass and size of busses, when they crash, people often get serious hurt.

A private bus operator may be sued in court like any other private individual or business, and, generally, the statute of limitations for a claim against a private bus operator is three years. A claim against the MTA, RBO or NYCTA (or any other government agency), however, may raise the issue of governmental immunity and always requires that a notice of claim be filed within ninety days of the accident before going to court, and that the formal lawsuit be filed within one year and ninety days of the accident.

When a bus driver commits an illegal act, such as driving while under the influence of drugs or alcohol, the employer may also be liable under a theory of respondeat superior, negligent hiring or negligent supervision.

When a bus service provider allows passengers to board one of its buses, it is representing that the bus is in proper working order and is safe for ordinary use.
