Construction Accident Attorneys Helping Victims Throughout the Greater New York City Area
The Bronx lawyers at Jesse Minc Personal Injury Law help people involved in construction accidents throughout New York City get the full compensation available to them under the law. Our attorneys combine decades of experience and significant resources in pursuing workers’ compensation and disability insurance benefits, as well as other legal remedies against those responsible for your injuries such as through personal injury lawsuits alleging violations of Labor Law Section 240, Labor Law Section 241(6) or Labor Law Section 200 if a lack of adequate safety measures on a job site cause you to become seriously injured. We make a point of considering each individual client’s unique circumstances, crafting a legal strategy tailored to their needs, and hiring the right expert witnesses to prove every element of each individual client’s case. Our Bronx construction accident lawyers offer free consultations and will investigate your case at no charge. If we accept your case, we put our own money behind your case, and you never have to pay for our expenses (no matter how large they may be), nor do you have to pay us a penny of legal fees, unless we win your case by obtaining a settlement or a judgment after a jury trial
If you or a loved one is injured at a construction site in New York, there are a variety of different options for compensation that may be available. These include workers’ compensation and disability insurance, a safety net for New York workers that takes effect if you are injured outside the workplace. Our firm has inimitable expertise in representing victims of construction accidents, and can help you obtain all of the benefits and compensation to which you are entitled if you are injured on a construction job site.
Workers’ Compensation
Workers’ compensation is a form of insurance in which your employer pays into a plan so that cash is available in the event that you are injured on the job. The benefits include compensation for all of the medical bills and at least some of the wages that you miss while recuperating. Most New York employers are required to carry workers’ compensation insurance. The benefits are only available to those workers who are or should be classified as employees rather than independent contractors, although independent contractors can often obtain workers’ compensation coverage in context of construction accidents through special agreements between the developer and the construction manager and subcontractors that may apply to a particular job site.
To get workers’ compensation benefits, you need to prove that you suffered your injury or contracted your illness in a way that “arose out of” your work. Thus, for example, a construction worker who falls from a ladder on a job site is likely eligible for benefits. (They may also be able to pursue damages through a claim under the New York Labor Law, and our Bronx attorneys can discuss their options with them.) It is important to remember that you do not need to prove that your employer is actually to blame for the injury or illness. You do, however, need to notify the company of your injury or illness within 30 days and file a benefits claim within two years.
Disability Insurance
New York is one of a relatively small number of states that also require businesses to carry disability insurance for workers who are injured. These temporary cash benefits are available for people who cannot work for a certain time because of an injury or illness. They are designed to compensate the worker for lost wages. Benefits cover 70 percent of your normal pay, up to $170 per week. However, disability insurance benefits do not cover related medical costs. They are available for up to 26 weeks over a one-year period
To get the benefits, you need to prove that you suffered an injury or illness that has left you unable to do your job. The specific eligibility requirements may vary based on the terms of your employer’s disability insurance plan. Independent contractors are typically not covered by these plans.
