Slip and fall accidents generally refer to accidents in which a person steps on a slippery substance, falls and gets injured on another person’s property. Usually, these types of accidents are caused by the negligence of the property owner in connection with their failure to use reasonable and appropriate diligence to discover and remove slippery substances from their property, or to warn others of the presence of a dangerous condition. Head, neck, and back impairments, including broken bones like hip fractures, are some of the most common injuries sustained in slip and fall cases. In some tragic, and very rare, instances, these accidents can also result in death, especially where the slip-and-fall accident occurs in the vicinity of a staircase or open pit on a construction site.
If you or a loved one is injured in a slip and fall accident in New York, state and local laws give you the right to seek compensation from those responsible for the accident. The slip and fall attorneys at our Bronx law firm can help you investigate your accident and gather evidence for your claim. The defendant is usually the owner of the property where the fall took place; and other defendants may include a property manager hired to oversee the operation of the property, or a tenant who has leased space at a building. The damages sought by victims of a slip and fall often include compensation for current and future medical damages, missed wages and any reduction in future earning capacity, and pain and suffering. Relatives of a person who dies in a slip and fall accident also have the right to seek compensation for their wrongful death.
Premises liability is the legal theory most commonly used to help people injured in slip and fall accidents get the compensation that they deserve. Property owners owe a “duty of care” to anyone who steps foot on the property. Generally, the property owner is expected to keep the premises in a reasonably safe condition and to warn people of any hazards of which the owner knows or should know through a reasonable inspection. If the property violated a building code, for example, this would be strong evidence of the owner’s fault.
The battleground of any Bronx slip-and-fall accident lawsuit, however, almost always relates to the concept of “notice”. In context of a slip-and-fall accident, “notice” refers to both actual knowledge of the dangerously slippery condition (i.e., was the defendant actually told about the dangerous condition before the accident), or, where actual knowledge cannot be proven, whether or not the dangerously slippery condition was present for a sufficient amount of time prior to the accident so that the responsible party should have discovered it and remedied it before the accident was allowed to happen. Our Bronx accident lawyers have proven “notice” in hundreds of lawsuits, and will put our expertise to work for you in your case to prove that you are entitled to compensation if we accept your slip-and-fall case.
Take, for example, a person who slips and falls in a grocery store aisle that was made slippery after another customer spilled liquid on the floor. If the floor remained wet for a substantial period of time after the spill and before the fall, a jury is likely to find that the owner should have known about the wet floor. If a store employee was made aware of the spill, the owner may also be considered to have been aware of the spill. If the owner failed to take adequate steps to clean it up or warn visitors that the floor was wet, therefore, the owner is likely liable for any injuries caused as a result. If none of this is proven, the injured person will go home empty-handed, no matter how serious their injuries may be.How Our Bronx Slip and Fall Attorneys Can Help If You Call Us Today
