Workers’ Compensation

Workers’ compensation is a form of insurance in which your employer pays into a plan so that cash is available in the event that you are injured on the job. The benefits include compensation for all of the medical bills and at least some of the wages that you miss while recuperating. Most New York employers are required to carry workers’ compensation insurance. The benefits are only available to those workers who are or should be classified as employees rather than independent contractors, although independent contractors can often obtain workers’ compensation coverage in context of construction accidents through special agreements between the developer and the construction manager and subcontractors that may apply to a particular job site.

To get workers’ compensation benefits, you need to prove that you suffered your injury or contracted your illness in a way that “arose out of” your work. Thus, for example, a construction worker who falls from a ladder on a job site is likely eligible for benefits. (They may also be able to pursue damages through a claim under the New York Labor Law, and our Bronx attorneys can discuss their options with them.) It is important to remember that you do not need to prove that your employer is actually to blame for the injury or illness. You do, however, need to notify the company of your injury or illness within 30 days and file a benefits claim within two years.

Disability Insurance

New York is one of a relatively small number of states that also require businesses to carry disability insurance for workers who are injured. These temporary cash benefits are available for people who cannot work for a certain time because of an injury or illness. They are designed to compensate the worker for lost wages. Benefits cover 70 percent of your normal pay, up to $170 per week. However, disability insurance benefits do not cover related medical costs. They are available for up to 26 weeks over a one-year period.

To get the benefits, you need to prove that you suffered an injury or illness that has left you unable to do your job. The specific eligibility requirements may vary based on the terms of your employer’s disability insurance plan. Independent contractors are typically not covered by these plans.
